Research On Protection Of Interests Of Landless Farmers In The Process Of Urbanization In China

In recent years, China has entered a stage of rapid development of urbanization, however,at this stage, there were peasants, urban pollution and other problems, among the problems, the most outstanding is the question of landless farmers ' rights. Land is the most important means of famers' production. When farmers lost their land, their existence will be seriously threatened. Existing law on the protection of the legitimate rights and interests of landless farmers is inadequate or missing, this can lead to farmers who are forced to resort to extreme measures to seek relief, ultimately social stability will be fluctuated. the problems of Land-lost farmers do required solving in time, because it not only relates to the healthy development of the urbanization process,but also relates to the community's prosperity and stability.Solving land-lost farmers' problems is to solve the land problem, and that urbanization brings the value of land allocation and the rationality of the distribution system. This article by collecting a large amount of literature on "urbanization" and "peasants" brief analysis concepts and features, a clear understanding of "urbanization" and farmers" means; Making conclusion of the situation of land-lost farmers, and divided it into reasonable levels. Using of the comparative method and compared the practices of Western countries, focusing on the interests of farmers comprehensive analysis of reasons. Ultimately concluded that the root cause of the problem and the specific cause of landless peasants: urban and rural dualistic economic structure is the fundamental reason, why is the Government authority to use nonstandard, not rational, legal system is not perfect, the lagging behind urbanization development.According to the analysis of causes of impaired the interests of farmers, building solutions, from the root cause and specific reasons, we suppose to construction a limited Government, standardizing Government's power, building equality of rights, the rights of legal unity system, improving the legal system.
