Analysis On The Improvement Of Resident Committee Organization’s Legislation

Residents’ committees are grassroots self-organizations with the clear position according to Constitution of the People’s Republic of China. In recent years, residents’ committees are running with administrative trend seriously, and Residents’ Committee Organization Law is being shelved. This paper tries to protect the autonomous organization status of residents’ committees to prevent their interests from being handled by the administrative power. This paper consists of three parts. The first is about the analysis of current legislation situation of Residents’Committee Organization Law, which includes the bringing forward of the residents’ committees’concept and the system arrangement of its character, status, responsibility, mode of production, supervisery mechanism and so on. The second part is about the legislative loopholes and practical problems of Residents’ Committee Organization Law, including but not limited to the deviation of the character and status of residents’ committees, the ambiguous relation between the government and the people, the imperfection of election system, and being lack of efficient democratic decision-making and democratic supervision mechanism, where the causes of the problems have been analysed and the necessity of improving the legislation of residents’ committee has also been briefly stated. In the third part, considering the actual current social development, some practical countermeasures about how to improve the legislation of residents’ committee have been put forward with the aim of reducing administrative influence and returning to the committee autonomy. Some ideas about how to modify Residents’ Committee Organization Law have been made, based on the clear and definite status of residents’ committees’ responsibilities, the relation between residents’ committees and the basic governments, the standardized electoral system of residents’ committees, and improving democratic decision-making and democratic supervision mechanism of residents’ committees.
