Study On Chinese After-evaluation System Of Local Government Regulations

Recently years,our legal system become more and more perfect,our country have paid more and more attention to the quality of legislations, especially to the quality of local government regulations. They have all kinds of connections with people’s life directly. Local government regulations can not always keep well functioning when they promulgation. They need to keep pace with the times, changing along with the development of practice. This paper introduces the after-evaluation system of local government regulations. this system provides the ways of evaluating local government regulations which has been implemented for a period of time through certain procedures and standards, making certain response according to the assessment results, and the purpose of this system is to perfect the quality of local government regulations. Now no place has formed a unified system about the after-evaluation system of local government regulations, The author introduced the understanding and the perfecting advice of the system, looking forward to promote the improvement and development of the system.This paper is divided into four parts except introduction and conclusion:The first part introduces the basic theory of the after-evaluation system of local government regulations, including the conception, characteristics, theoretical basis and necessity, According to theoretical part to clarify what the system is and its importance.The second part introduces the present situation about some of this system of our country, including the relevant practices of the areas of our country and the existing problems, for instance, the subject are simple, standards are not unified and procedures are not standardized. Figure out the defects of our country system, which can be modified.The third part introduces some foreign administrative system situation of the after-evaluation system of local government regulations, including American, Britain, Germany and Japan. Making a brief description of their formation, evaluation and assessment standards, to take its essence to perfect our country system.The fourth part is about five suggestions to perfect the after-evaluation system of local government regulations, the first is establish a diversified evaluation subject which include makes、implementers、expert and so on; the second is make an unity evaluation standard which can make a more comprehensive assessment; the third is design a variety of evaluation methods; the fouth is improving the standardization evaluation program and the fifth is build an effective response mechanism.
