Research On The Construction Of The Control Mechanism Of Shandong Tobacco Legal Risk

After three decades of rapid development, China’s economy has entered a new normal development model. Under the new normal economic development, environmental degradation, social conflicts accumulation, structural imbalance in economic development and other issues overshadowed by rapid economic development become more prominent,which have become a destabilizing factor of social development, and enterprise management. In this case, the central and local governments have to adjust their development evaluation methods, companies pay more attention to the quality of development, explore new ways, an important aspect of which is Corporating governance in accordance within the legal framework. Especially the eighth session of the Fourth Plenary Session,the first thematic meeting,researched Chinese construction through legal governance, which pointed the importance of the law from the national level of the whole society.it is foreseeable that in the next period of time, the concept of the rule and measures of law will be increasingly more specific and detailed, which will deeply affect all sectors of society.Currently methods and approaches to strengthen enterprise management are very much,but mostly of which is in order to enhance corporate management level and prevent part of the risk from one side. As a social subject, enterprises interact with various subjects.So eliminating every risk is a very complex problem. From a legal point of view,our current law has more than a hundred departments,whch is divided into Civil Law,Criminal law, Administrative law and International law,covering all aspects of national social development. Under certain conditions,you can say all kinds of venture finance,sales, investment and market can be thought of legal risk.We needs to strengthen the corporate legal risk management, establish prevention and control system including the content of legal risk identification, assessment and response,as well as the accompanying risk control system and management methods.So legal governance and business management can combine, so as to improve enterprise management level.In this paper, for the example of Shandong Tobacco system, combined with practical experience in the construction of the mechanism of Shandong tobacco prevention and control legal risks,firstly,define the concept of legal risk and legal risk management,describe the research statusthe of enterprise risk management and legal risk management,and summarize the characteristics and shortcomings of the research. Secondly,resolve the general risks and legal risks specific faced by Shandong Tobacco systems,and analyze the reason the legal risks arising.Finally, explore the methods to establish legal risk prevention and control system from che aspects of system, organization and regulatory,and probe the establishing and improving methods of legal risk prevention and control mechanisms.This paper argues that raising the level of legal risk management of Shandong Tobacco, need to establish legal thinking,which starting from combing the whole business process, systematically and comprehensively identify, assess and respond to legal risk,develop practical legal risk management approach based on the actual situation.Then, in conjunction with other management systems of the enterprise, develop a set of effective internal prevention and control mechanism, covering the full scope of business and the whole business process.
