The Obstacles In The Implementation Of Information Disclosure Provisions Of The New “Environmental Protection Law” And The Countermeasures

The public power has been growing gradually in a series of environmental events,and the prerequisite for effective public participation in environmental decision-making and regulation is the adequate environmental information disclosure.The information disclosure provisions of the new “Environmental Protection Law”include the government environmental information disclosure,the focus pollution emissions units environmental information disclosure,and the construction project environmental impact assessment information disclosure.It is different from the past in terms of subject, content, methods, etc.The new rules must put forward new requirements to environmental information disclosure in our country.Meanwhile,some problems of environmental information disclosure that practice remains are unresolved.Therefore,the urgent task is that how to deal with these challenges in order to ensure the adequate, timely and effective implementation of information disclosure provisions of the new “Environmental Protection Law”.In order to solve these problems, the paper uses the summarize,comparative analysis,empirical analysis and other research methods.It combines with the relevant data and cases of practice in our country,and learns from the advanced experience of other countries in the field of environmental information disclosure.To guarantee the government environmental information disclosure by strengthening the law enforcement work of environmental regulatory authorities, determining the scope of confidentiality, improving the openness of environmental monitoring information, enhancing the level of information disclosure work. The measures for ensure the focus pollution emissions units environmental information disclosure,include identifying the range of the focus pollution emissions units,increasing the cost of illegal,standardizing the management of environmental reporting system for key pollution units,improving the regulatory system,and concentrating the public forces to strengthen social supervision.The measures to promote the construction project environmental impact assessment information public,include determining the scope of public objects to limit selective EIA of construction projects,perfecting the way of disclosure to guarantee public access to EIA information,promoting the openness of EIA review process,determining the liability of construction of EIA false public,establishing the model of community environmental roundtable meeting to facilitate two-way exchange of information.Of course, the problems may be more than the paper discussed when put the information disclosure provisions into practice, and the solutions to the problems are not limited to this. I believe that environmental information disclosure system toward a more perfect bound direction as our awareness of environmental issues maturing and the environmental legislation improving.
