Research On Farmers’ Rights Protection In Land Acquisition And Demolition

With the development of industrialization and urbanization,construction land occupied agricultural land place becomes a more and more common phenomenon, farmers’ rights protection in land acquisition and demolition also received more and more attention. Land acquisition and relocation means the government confiscates farmers’ land according to legal procedures and authorities, dismantles farmers’ houses and other property in land, compensates and installs these farmers in order to satisfy the public interest. In the process of land acquisition and demolition,farmers’ land rights is a private question about civil right protection in nature. The content of farmers’ right includes right to know, personal right,property rights, and rights as a member of the collective. But farmers’ these rights can’t get enough protection, register as farmers’ right to know is neglected, compensation fees is low, lack of safeguard measures and relief approach. Farmers get the least profits as land occupiers and users in land acquisition and demolition process, in order to protect farmers’ rights, we should pay more attention to perfect interrelate systems.Exploring the development history of land acquisition and demolition in China, and learning from other typical countries’ experience, to build farmers’ protection of rights in land acquisition and demolition in our country, we should improve five aspects: respect and protect farmers’ right to know, reasonable compensation fees, strictly limit the government’s compulsive behavior, strengthen safeguard measures and law rescues. Only we improve all these five aspects, can we protect farmers’ rights in a more comprehensive way.
