Intangible cultural heritage is an important cultural information and resources in china. Non-material cultural heritage is the witness of history development, is of great value. Especially in Chinese minorities intangible cultural heritage, it is a precious cultural heritage of China, is the Chinese national culture essence. With the development of economy, the protection of non-material cultural heritage has been paid great attention by in all countries. Many countries have adopted a series of protection measures to protect intangible cultural heritage.With the development of economy and the national modern civilization, more and more attention has be paid to the protection of intangible cultural heritage. As the act of the intangible cultural heritage of the People’s Republic of China, China opened the door of the non-material cultural heritage legal protection. The ethnic minority autonomous region were developed a series of local rules and regulations to protect the local minority intangible cultural heritage in recent years, but did not build into a perfect legal system. Many local regulations of ethnic intangible cultural heritage has conflict in the protection of the law.Our country is areas and have the heavy minority intangible cultural heritage, but many of the intangible cultural heritage were not protected well. Many of the non-material cultural heritage is facing inheritance, absence of precious object is destroyed. Minority non-material cultural heritage is not concentrated distribution, there are a lot of distribution is located in not very developed area, so the legal protection of intangible cultural heritage in ethnic minority should be careful analyzed and then put forward the reasonable solution. Legislation is the most powerful for protection of minority intangible means, but it is not enough. We should also cohesion of power from the government, the media, the public to protect the intangible resources of our country.The author starts from the predicament of protection in the ethnic minority intangible cultural heritage and analyzes he insufficiency of the legal protection of Chinese minority intangible cultural heritage and puts forward some suggestions to the laws of the Chinese minority intangible cultural heritage protection.The first part of this article mainly introduced the minority intangible cultural heritage’s basic theory. Including ethnic intangible cultural heritage conservation and value of the concept, characteristics and its significance of intangible cultural heritage. In this section the author takes Guangxi as an example to demonstrate the arguments.The second part simply introduces the legal protection in terms of the heritage protection which is in advanced foreign, and also makes simple introduction to the status of legal protection in our country minority intangible cultural heritage. This section also analyze the legal protection of non-material cultural heritage in ethnic minority provinces, and make simple analysis for legislation’s characteristics of the local non-heritage protection.The third part is based on the simple analysis of the plight of the heritage protection of Chinese ethnic minorities, proposing the loopholes and defects of the legal protection. In this section the author also makes the concrete argumentation based on the situation of Guangxi.In this paper, the fourth part is the focus of this article. In this section, the author put forward the legislative Suggestions to our country minority intangible cultural heritage protection of the law. Including the basic principles of legislation and what kind of legislative model should be established. The last section puts forward a series of specific measures for the protection of China’s ethnic minority intangible cultural heritage, strengthening the legislation of operability. having the theoretical and practical significance.
