The floating population in urban employment discrimination, and get different pay, the most bitter and tired work, also often unpaid or withhold wages, cannot enjoy the urban social security, their children to school difficult, living environment can not meet the safety and health standards, is not really integrated into urban life, no sense of belonging, become the emphasis and difficulty in today’s society and the public security management. There are many reasons for the floating population’s rights are violated, are both the historical, institutional barriers, unbalanced regional development and the incomplete laws and regulations, there are conceptual discrimination, own quality low reason of the floating population. Discusses the issue of protection of the rights and interests of the floating population, build a long-standing mechanism to protect the rights and interests of the floating population, to share the fruits of reform and development of the floating population, to respect and safeguard human rights, improve the level of urbanization in our country, to speed up the socialist modernization construction, maintain social harmony and stability, and realize social justice and so on is of great practical significance.This paper used literature study and inductive analysis method. By collecting and organizing the literature concerning the rights and interests of the floating population of and policies, grasp the research front, the formation of ideas and research framework of this article. This article is divided into five parts:The first part is introduction, mainly puts forward the research background and research methods, and literature review.The second part is the first chapter, on the protection of the rights and interests of the floating population are summarized. The concept of the floating population and analyzes the connotation of the rights and interests of the floating population, from the vertical system carding and summarizing the history of the policy in the rights and interests of the floating population in China, introduce foreign system of management of the floating population from the cross, from floating population management system in the developed countries experience worthy of learning and enlightenment.The third part is the second chapter, analysis of the problems existing in the protection of the rights and interests of the floating population in China and causes. The problems existing in the protection of the rights and interests of the floating population in China mainly displays in: labor employment rights infringement, including employment discrimination, labor security, no security, the right of labor and labor remuneration rights infringement, didn’t get to the city official workers’ vocational skills training of equality of opportunity; Social security is missing, the accepting units without pay of industrials injury insurance for the floating population are widespread, endowment insurance and medical insurance payment standard is high, the overall level is low, transferring difficult, low rate of the floating population, high surrender rate; Floating population educational inequality, their children in difficult; Poor living conditions, have not been incorporated into the urban housing security system. The cause of the problems summarized as follows:"binary" household registration system between urban and rural areas, regional economic development imbalance, lagging legislation, law enforcement is lax, the judicial relief, the relevant government department management, service management concept, its floating population culture quality and legal consciousness is low.The fourth part is the third chapter, put forward the countermeasures of perfecting our country’s protection of the rights and interests of the floating population. As the urban resource environmental bearing capacity is limited, the household registration system reform can’t one pace reach the designated position, should adopt the mode of gradual reform, comprehensively implement the residence permit system, the integral management, steadily promote the reform of household registration. From to establish a unified urban and rural labor employment market, the social security system as a whole, guarantee of the floating population children the right to education and construction of housing security system for the floating population to establish the protection system for the floating population. From the perspective of perfecting legislation, law enforcement, judicial and provide legal guarantee for the protection of the rights and interests of the floating population.The fifth part is conclusion, summarizing the content of the article, reiterated that the point of view, this paper points out that this article needs to be perfect, and for the future protection of the rights and interests of the floating population was discussed, with the development of economy, the country’s ability to provide basic public services, set up and improve the protection of the rights and interests of the floating population system, the rights and interests of the floating population will receive a fair and comprehensive protection.
