The Research Of Unemployment Insurance Law System

Since the sixteenth meeting held in 2002,The people’s livelihood aroused more and more attention.The eighteenth also attached great importance to the people livelihood.The unemployment is an important factor to livelihood.since we run the market economy model,more and more laborer lose their job.The unemployment is an inevitable phenomenon of the market economy model.In terms of nations,it is one of the factors which cause social unrest,the unemployment not only causes the waste of the talents,but also it has a relationship with the social rest,because the high rate of the unemployment always is accompanied by the high rate of the crime.when the unemployment is more than the tolerance of the social,it may cause social unrest.For personally,unemployment means labors lost their life source,and their basic life difficult to get ensuring.The unemployment insurance law system as a new adjustment tool of unemployment,is an result of social development and it is an effective model of social problems.For personally,the unemployment insurance law system can be used to safeguard unemployed persons basic life during their unemployment.In the term of the social,the unemployment insurance law system is the important part of the social security system which consists of endowment insurance, medical insurance, injury insurance and maternity insurance,the scientific and reasonable unemployment insurance law system can help maintain the stable social order,and helps build a good order.In this sense,the unemployment insurance law system is an tool to maintain national stability.Based on the above meaning,I chose the unemployment insurance law system as my thesis,and the passage consists of four parts.The first part is the basic theory of unemployment insurance law system.Because the basic theory is the necessary theoretical preparation of the analysis of the unemployment insurance law system.It consists of the definition of unemployment,the definition of the unemployment insurance and the characteristics of the unemployment insurance.I regard all of it as the basic theory of unemployment insurance law system.The second part is the foreign legislative case and its analysis.It mainly introduced the Germany, Sweden, Japan, the United States unemployment insurance legal system related content,on this basis,make a comment on unemployment insurance system.In this way,I summarize the characteristics of the unemployment insurance system of those country and get the reference and revelation which is beneficial to improve the unemployment insurance system of China.The third part is the the legislation present situation and the insufficiency of unemployment insurance system in China.This part is based on the present situation and the implementation of China’s unemployment insurance legislation and summed up the problems of the unemployment insurance legal system in our country at present.The last part is the most important part of the passage.This part is corresponding to the shortage of the third part. According to the thinking of "question- problem solving" and based on our country’s specific national conditions,I draw lessons from the foreign useful experience in the process of implementation to put forward the corresponding opinions and suggestions.
