| Construction quality problems concerning life safety and everyday life of Thousands of households are closely related to people’s rights and interests. The status quo of construction quality in China is not optimistic despite of large-scale development and construction, from which many social conflicts and disputes arising. Therefore, it is of dramatically practical importance to study how to solve the construction quality problems and related conflicts.Through legal analysis of problem-solving approaches of the current construction quality, this paper proposes that accountability mechanism of project quality be perfected and insurance system of project quality be set up, which are supported by some detailed suggestions of improving measures and pathways.It is divided into four chapters. The first chapter introduces the status of construction project quality problems including their types and characteristics and causes. This chapter reveals that institutional deficit and ineffective supervision plays an important role in the arising of the problems. Chapter two starts from an analysis of legal responsibility related to project quality, pointing out administrative responsibility should play the role of prevention prior to the problem rising and civil responsibility the role of remedy afterwards. On the basis of the analysis, it concludes further that in order to guarantee the project quality, prevention in advance should be strengthened and project accountability mechanisms be perfected through improving current regulatory system and other ways. Chapter three expounds the plight of remedies afterwards, the useful experience of project quality insurance systems in foreign countries and their significance to China, indicating the necessity and feasibility of establishing the insurance system in China. Chapter four further explores how to set up the insurance system of project quality, including its content, current status of implementation, and safeguard measures. |
