The Legal System Of Farmer Rights And Interests In The Central Soviet Area And Its Modern Revelation

The researching of the peasant issue is not only a significant part of Marxism but also of Chinese revolution and construction. The core of the peasant issue lies in rights and interests. How to protect the rights and interests of peasants determines whether it could mitigate the peasant issue. During Central Soviet Area period, protecting peasants’ rights and interests was first legal practiced, which indicates a significant direction in contemporary China society on continuing to deepen rural reform, solving the problem of “agriculture, rural areas and farmers” and on the construction of legal system in China.The thesis discusses the issue of protecting the peasants’ rights and interests in a time when the Chinese Communist Party governed the country for the first time. The thesis starts from the historical background of the Central Soviet Area guaranteeing the peasants rights and interests, analyzes the peasants’ basic situation in modern China and the importance of the peasant issue and the important significance of protecting peasants’ rights and interests in the Chinese revolution from three aspects; Then the thesis sums up four aspects with legal safeguarding for the peasants’ economic rights、political rights、cultural rights and Rural women’s rights; Then the thesis not only summarizes three basic experiences from the historical reality including paying attention to the research on the peasant issue、strengthening the construction of the communist party of China and establishing a perfect system of law enforcement, but also reveals three aspects of historical limitation including the negative impacting to the protecting peasants’ rights and interests with “Left” errors in the party ideas line、some legal divorced from reality and a coarse in the legal construction each link; Finally, this article generalizes the modern revelation of the practice of legal system in this period, on the one hand is the three enlightenments to continuing to deepen rural reform, solving the problem of “agriculture rural areas and farmers” including paying attention to the research on the problem of “agriculture, rural areas and farmers”、always running through the rural reform with “People-oriented”、paying equal attention to “the rule of law” in the process of rural reform; on the other hand is the three enlightenments to “the rule of law” in China construction including further improving the legislation; “the rule of law” should be the main method in the rural reform and must running the party strictly by law.
