Coupled with the development of era, homosexuality, as a kind of subcultural phenomenon, has been a new social relationship which has been attached great importance to.However, the concept of "marriage is among male and female "has been rooted in our thinking. As a result, whenever we talk about the same-sex marriage we are inclined to condemning it in moral scope, hoping it to be badly punished and considering it to be a kind of illness. However, the diversities of thinking promotes the diversities of value choices. Homosexual identity has been more widely accepted by our society, especially in China. However, because of oceans of traditional reasons, there exists contradiction between the objective reality、the emergency of protection of the homosexuality and the masses’ acceptable level. At present, some people are calling legislation to it,but in practice it is still a blank.However, contrary to China, the legislation to homosexual relationship in western countries has developed from theory to practice, their rights have been protected,their social status has been greatly elevated,meanwhile,this is also the symbol of western civilization." Stones from other hills may serve to polish jade".The research of situation of western legislation of same-sex marriage and its mode has been instrumental in erecting our own legislation.This paper attempts to start with the development of peoples’attitudes to it so as to demonstrate its legitimacy and necessity. Apart from this I aslo research it from the scope of law and sociology in order to demonstrate the necessity and feasibility and the obstacle of institutional challenges. At last I find the feasibility of system of same-sex registration. Even nowadays, it is impossible to have legislation to it,we still should have a reasonable attitude towards this phenomenon.
