| The current "the villagers committee organic law" was tried to run after commissioning on June 1, 1988, passed in the ninth session of the standing committee of the National People’s Congress the 15 th meeting on November 4, 1998, and revised in the 11 th session of the standing committee of the National People’s Congress the17 th meeting on October 28,2010. By many years’ practice of the villagers’,villagers’ autonomy had obtained certain progress and development, and villagers’ autonomy level had improved, this strengthened the rural democratic construction of the rule of law, and the masses of rural grassroots democracy has also been improved. But at the same time,we should also see that, villagers’ autonomy still exist deficiencies in many ways, the villagers’ autonomy level should be further to strengthen and improve. Villagers recalled as a basic villagers villagers’ democratic rights, democratic elections and democratic supervision in the villagers’ autonomy in has the important status and role, it directly relates to whether the democratic elections fell on feet, relates to whether the villagers form of villagers committee form the restriction and supervision, relates to whether the villagers in exercising its real as the main body should be one of the core rights enjoyed by the villagers’ autonomy, but, if villagers cannot fully exercise recalled,not only the legitimate rights and interests of the villagers not guaranteed, but also affects the development level of the villagers’ autonomy, eventually hinder the further development of the whole democracy system.This paper is divided into three parts: the first part analyzes the villagers recalled the theoretical basis, summarizes the villagers recalled the legal value and meaning. The second part analyzes the villagers recalled the development process of the legal mechanism, and put forward mechanism, the acceptance mechanism, focus on the program specification mechanism and supervision mechanism of the four aspectsexplains the villagers recalled the defect of legal mechanism. The third part is the focus of this article, as well as in the proposed mechanism, the acceptance mechanism, the program specification mechanism and supervision mechanism of the four aspects of the villagers recalled the perfection of legal system are analyzed and discussed. |
