The Research Of Medical Dispute Hearing System

In recent years, people have become increasingly demanding for medical environment and doctor’s service with the deepening of China’s social reform, rapid economic development and the general increase in the culture and education level. According to common sense, the harmonious doctor-patient relationship is the basic guarantee for good medical effect. The relationship between patients and doctors should be base on mutual trust, mutual respect, mutual cooperation. However, doctor-patient relationship in China is not satisfactory for various reasons, the doctor-patient relationships have become increasingly worse and medical disputes are showing a rising trend, even "medical trouble" phenomenon happen widely in some places and result in a very bad social impact. At present, how to deal with medical disputes has become a "headache" for doctors, patients and governments, especially the health administrative departments. How to handle medical disputes with effective, orderly and lawful methods has become a issue of common concern to all levels of government and the community. However, due to a variety of historical and practical reasons, there are obvious defects in current medical dispute settlement mechanism which have been unable to effectively resolve doctor-patient conflicts, to ease the doctor-patient relationship. It is extremely important practical significance for us to construct diversified medical dispute resolution mechanism by investigating and learning from foreign well-established medical dispute resolution mechanism and is hopeful to improve the status of increasing medical disputes and the deterioration of the doctor-patient relationship. This paper is divided into the following sections to argue for medical dispute hearing system in China.Part Ⅰ, The concept, value and evolution of hearing system.
