The Research Of Chinese Census Law

China is the most populous country in the world. According to the6th population census, there are about1.339trillion people, including service man distributed in30Provinces, autonomous regions, municipalities directly under the central government. However its legal basis is limited to the Account Registration ordinance which was passed in The9th National People’s Congress Standing Committee in9th Jan1958(hereinafter referred to as registration ordinance). Obviously this ordinance which was established54years ago cannot meet the requirement of household management after going through a decade of turmoil, and30years of reform and opening up. As a police who has devoted to the household registering in about10years, I will analyze the existing problems and solutions from the perspective of law-executor or the executor of Census Law and from the shallower to the deeper, the surface to the root based on daily experiences, communications with the public and practical cases.This article can be divided into5parts. The first part introduces the present situation of China’s current Census Law, which will be specifically analyzed from the structural system, content and major functions. The second part introduces the historical revolution, including household registration code and major household registration system in ancient times and its development in recent China and after the establishment of new China. The third part is based on the practical situation of the author with a large amount of cases to introduce the application in public security organs. And they are embarrassing situation of lagging legislation, hard to follow laws and no law can be followed; disadvantages of self-managed and act of free will; and understanding of additional benefits. The fourth part summarizes main problems existed in current household registration. Firstly it is the unreasonable structure of pyramidal type legal system. Secondly it is about the additional benefits which make it hard to carry out the reform of it, and related act is hard to appear on the stage. Thirdly, it is about poor control in population and household relocation becomes benefit-oriented. The final part puts up with reform ideas based on the social and economic development, which includes three steps. The first step is to deepen the reform of Census Law and deprive additional benefits, and the second is to publish Census Law Act and establish detailed regulations adapted to the whole nation and the last step is to change the management method and philosophy and establish resources which can be integrated.Contradictions are constantly protruding to show with the development of society and economy because of the imperfections of Census Law, what’s more the necessity of reform is in urgent need and has been widely recognized. The development between historical evolution, society and economy is uneven, which will definitely be arduous and circuitous to develop. So only by striving for the best from ups to downs, grasping opportunities, deepening reform, perfecting resource matching mechanism, Census Law and law enforcement supervision, can we set up Census Law which is suitable and can be adapted to the social and economic development.
