Compared with China’s public rental housing and commercial housing propertymanagement systems, there are some distinctive personality traits as well ascommonalities. It is calling for a comprehensive property management system, butthere are still many problems currently. The core issues are that how to determine andreconstruct the boundaries of the obligations of government, the rights of the propertymanagement company and the lessees. Is it insist on the executive-led mode or lesseeautonomy? How to design the autonomous mechanism,can they set up the committeewhich is similar to the nature of the owners’ committee?Since the inadequate research on particularities of public rental housing propertymanagement and its theoretical basis, which led to the lag of legislations. They are thevery reasons why there are so many other problems in public rental housing propertymanagement system. So the problems will be solved and the systems will be builtwhen the theoretical problems are cracked.It will be inefficient and unsustainable when we ignoring the market mechanismand fully relying on the state administrative measures. In other words, either thecompletely control of the market or the absence of the government functions will notmake the problems resolved completely.Therefore, by researching on the relative ownership theory, the thesis finds sometheoretical supports for giving finite rights of property management to the lessees,andthen analyzes the obligations and responsibility borders of the tripartite legal subjectsbetween the government, property management company and tenants. The paperconcludes that the government should be defined as the role "to strengthenmacro-control, to undertake the social management functions, to buy social services";the property management company ought to provide professional services and thelessees have rights of self-management. Ultimately, we are aid to establish thequasi-market model of the public rental housing property management.
