The Causes And Prevention Of Illegal Land System Of Hainan Province

With the development of China’s economy and society, the process of urbanization is speeding up, the land of scarce resources become more precious. Hainan province,located at the southernmost tip of motherland, has kept a good air quality for99%of the time in the whole year of2014. While other most regions of the country plagued by haze weather. With the advantageous natural environment,clean water, green hills,and blue sky,combined with the construction of international tourism island strategy, Hainan province has achieved success in reform and development in recent years. But in the process of development, a series of land illegal behavior such as illegal approval of land, illegal use of cultivated land, illegal occupation of land have become a grim problem that we must face. The occurrence of illegal behavior has its institutional causes.In order to deal with illegal behavior, what we need is finding loopholes and defects in the design of system,which will lay foundation for improving all the existing system of land.This paper analyse and research on the part of the land illegal behavior,based on the situation of land management of Hainan province. These behaviors most occured on the real estate developers and officials who master the land approval authority. The characteristics are many illegal links, large illegal area and collective illegal behavior.Through from the actual situation of Hainan land,the author analyse loopholes and defects existing in the land system fom the system construction by using the theory of politics and economics.In order to prevent and manage land illegal behavior from the system construction,,the author analyze from six aspects,i.e the land transfer system, land tax system, land charging system, local achievements appraisal system, land reserve system and land auction system, trying to find way to restrain the illegal acts related to land through completing system.
