The Legal System Improvement Of County Government Fiscal Expenditure On The New Rural Pension System

A new type of rural social endowment insurance officially started from October1,2010. Different from the old, the new one invited the collective organization andthe goverment to take a part in this insurance. Peasant will say goodbye to the selfsavings, and an equitable commitment should exist for every participator. The basicprinciple of this new insurance is: Cover the basic, Broad coverage, Rationality andSustainable. Its purpose is to confirm the grow old peasant`s basic life can besupported by the government. It will be tested at some typical places at first andexecuted all over the country later, the government at the county level takes theresponsibility to organize and implement this rural socilal endowment insurance. Thisnew system construction will release the peanant`s lfe burden, reduce the gap betweenrural and city, promote the township development, it`ll also promote the harmoniousof the social security system. According to the national plan, at the end of the TwelfthFive-year Plan, we`ll reach the combination of the new rural social pension insurancesystem and the town dweller social endowment insurance system, get ready tocombine with the basic old-age pension. Afterall, we`ll build a fair, unitive, normative system before2020.Superiors acting and inferiors imitating is not the only useful way to promote thesocial security. It is important to discover the physical truth among the different places,to arouse the enthusiasm of the local peanant, to find out the key to the government`srunning condition problems. It`s time to listening the inferiors, and put the system intolegal`s control. As a public good, the experience told that the government`s publicexpenditure is effective to social security system. At this time, on the way to the“legal state”,“service-oriented government”,“efficient government”, thegovernment`s public expenditure must follow the constitution and the conception ofthe law. Only then can this country`s environment become harmonious andsustainable.The thesis is a investigation report about a west pilot county------Lezhi. Lezhi hadbegan the new rural social pension insurance pilot project at the end of the2011, andhad executed allover the county after one year. Along with it, many problems cameout. Compare with the Central and East China`s pilot condition, the West China hasits own characteristic that mould by local financial resources and developmentpriorities. This investigation will do the data collection, the questionnaire survey andinterveiw the participator,like government,applicant,the villages and townsorganization, etc. Compare them with the published, and try to find out thecharacteristics and deficiency of the West China. The thesis contains five parts. Thefirst part: introduction, explain the thesis`s background and significance. The secondpart: literature review, describe the domestic and international literature between the2008and2013. The third part: legal principle, explain the legal priciple that willapply to the thesis. The forth part: the investigation report, the mian content aboutLezhi`s pilot project. The fifth part: idea and suggestion, based on the investigation,aim at the difficulty, state the personal view under the law. Use the own understandingof the law and financial, and try to figure out the pilot project`s system establishment,management and fund supervision. Dig out the problems, make some usefulsuggestions to promote this insurance, even the combination of the new rural socialpension insurance system and the town dweller social endowment insurance system.
