Due to the current actual situation of our country, the implementation is still the urban-rural dual economic structure, so such a system to determine the social pension insurance in China is also a binary, rural residents can not get in the short term urban residents the existing social security. From the actual situation in China at this stage to build a legal system of rural social endowment insurance and make it urgent task gradually improved, but so far only by the Ministry of Civil Affairs of China has formulated and promulgated in 1992, implementation of the county-level rural social endowment insurance basic plan and local legislation to guide the work, so far no national law to regulate rural social endowment insurance.China's rural population still accounts for a large population and the vast majority of developing countries need to continue to improve people's living standards, especially in rural areas need help and support for their country, it can be said to build rural endowment insurance in our legal system is very important significance. In this paper, the actual conditions in China, research on specific issues, summed up the relevant laws and regulations and policies of the current situation, analyzes the existing laws and regulations of some problems, and then made a number of building related to the legal system of advice and ideas.Germany, France and other countries in building their own rural social endowment insurance legal system should be more successful, but also achieved fruitful results, which we should be based on a teacher, to seriously study the successful experiences of other countries, we also not difficult to find in these countries the legal system of rural social endowment insurance full description of all rural social endowment insurance and the actual situation of national conditions and close contact, all with their own distinct characteristics.
