Freedom of speech and freedom of the press are the important political rights anddemocratic rights in China, which are in the basic position of civil rights system. The newsmedia as a member of the citizens, are entitled to the rights together with the citizens as well.The effective execution of free speech and press is the basis and premise of citizens’ right toknow, expression, supervision to be realized. The constitution and the "regulations on theadministration of publication" have regulations of speech and the press’ freedom, but most ofthem are principle rules. The rights of journalists are still lack of clear security, and theimperfection of the legislation, make that citizens’ right to know, the expression, thesupervision can’t be implemented.Facing the increasingly important position of the news media, it has become animportant factor that influences the government’ decision-making. It is necessary to guaranteefreedom of the press and it is not only the news media’s goal, but also an important content ofthe service-oriented government, for being feasible. Excessive supervision of the governmenton the news media may cause the events of infringing the legitimate rights of the news mediato occur now and then, or lack of government regulation cause false news to expand rapidly.Based on the pressing needs of the reality, and the shortage of the current published legalnorms in our country, some advices of reference significance are put forward for the newsmedia to better exercise its rights.The introduction section of this article mainly introduces the different points of viewabout this selected topic at home and abroad, and summarizes the significance of this selectedtopic, the research goal, research methods and innovations.In addition to introduction and conclusion part, this article has four parts.The first part outlines the changes of the relationship between government and newsmedia in China. From the point of publishing industry, it analyses the different periods of ourcountry legal status and the government management modes, displays four stages of changingrelationship between the government and the media.The second part analyses the current situation of the relationship between governmentand news media in our country. From the problems in supervision of the new rules, it furtheranalyses the current situation of the relationship between government and news media in ourcountry. Imperfect legislation, not enough attention to the media and the government positioning inaccurate result in excessive regulation or that the supervision does not reach thedesignated position.The third part analyses the necessity and basic principles of reconstructing therelationship between government and news media. Based on the defects of the governmentregulation, the principles of reconstruction are put forward, from the aspects of marketeconomy, government by law and citizen participation.The fourth part puts forward some suggestions for the reconstruction of relationshipbetween government and news media. On the direction, it seeks the balance of power andright, and the balance of management and supervision. Focus of reconstruction is to secure thefocus of the news media supervision of public opinion, both defining power line, to preventthe abuse of power, and clarifying the range of media rights, to prevent the spread of rightsbeing required. Finally, combined with related cases and legal norms, some suggestions onhow to improve the news supervision are put forward, from the aspects of improving theadministrative examination and approval system, the administrative punishment proceduresand the right remedy system and so on, to realize the guarantee of rights of the news media.The conclusion part mainly analyses some legislation problems about publishing.
