Objective:By confirming the concept of health care products, investigating the supervisionstatus of the market in Changchun. I tried to grasp the extent of consumers’ basicawareness for health supplies and current regulatory status, the attitudes and behaviorsof health supplies legislation. At the same time, I explored and analyzed the contentwhich needed to pay attention to in the legislative process in order to make reasonablesuggestions and to provide basis for local legislation of Jilin province.Methods:In this study, I used literature analysis, interviews, case analysis andquestionnaires for research. And I designed the questionnaire based on this. I selectedthe population in three administrative regions general in Changchun for handing outthe questionnaires. I also merged the interviews with administrative staff in healthplanning department, administrative staff in administrative examination department,health supervision and law enforcement, etc.Results:1. Through comparison and analysis of the different concepts of health careproducts in the local laws and that of the literatures, from the elements of function,character, using parts and the using way, to define the concept of health care products.Health care products are topical products that have health care function and multipletraits (liniment, patch, spray, etc.), except for the stipulated by the state products suchas medicine, medical devices, health food and cosmetics.2. Survey results showed that there were actually cognitive mistakes whenrespondents discriminate between health supplies and others. Especially for thejudgment on the accuracy of plaster for health supplies is low, at just18.6%.Respondents understand health supplies via multi-approaches. Except for145respondents who don’t use health supplies, among three age groups who know the products through ads are in the majority which account for32.7%,19.9%,18.9%.When meeting quality problems of the health care products, in the age groups ofunder age thirty and thirty to fifty38.1%and29.7%respondents choose to negotiatewith sellers,23%and24.8%respondents prefer to consult manufactures. In the agegroup of above fifty,40.3%choose to give up rights protection. Three age groups allhave the phenomenon of knowledge error or ambiguity on the understanding of thelaw of health care products and judgments on the supervision of the main body.3. By the interviews with the health and family planning administrativedepartments and the health supervision and law enforcement authorities as well ashealth supplies enterprises, we can know that the law of the health care products is notperfect so that it is restrict the development of health products industry. The validityof the measures for administration of health care products in Jilin province is one yearand the approval certificate of health care products’ expiry date is four years. Thelack of continuity of policy leads to the waste of technology and plant renewal. Illegalphenomenons still exist in health supplies market and harm the interests of producersas well as consumers’ rights.Conclusions:1. There is no a clear unifying concept in the law of health care products atpresent. Consumers have cognitive errors when defining health supplies.2. Health care products legislation is necessary for the unhealthy managementsystem of health care products market, and the unclearly responsibility differentiation.3. Be short of the knowledge of health care products affect the consumers tochoose the health supplies correctly and safeguard their legitimate rights and interests.
