Customs supervision and management of import and export as state machinery to safeguard national economic security and social stability have made outstanding contributions. Maintaining external trading orders and fighting against smuggling have also become an important link in law enforcement. Meanwhile,in the thirty years of the reform and opening-up,the phenomenon of criminal malfeasance have experienced profound changes, the customs are becoming increasingly serious criminal malfeasance spot. Because of this, analyzing the Customs officer malfeasance crime and the causes of this phenomenon,and putting forward suggestions on prevention and defense mechanisms have undoubtedly great significance.Based on the Organizational Behavior and Incentive theories in the field of public management,we analyzed the customs officers malfeasance crime types and features in depth,using the combination of normative analysis and empirical analysis as well as literature review methods,and we specifically focused on four cases studies,and regulation infringement crimes home and abroad were reviewed,and we summarized China Customs officers’ misconduct features and forms of infringements,and comprehensive analysis of the status quo and the main factors affecting Customs officer malfeasance crime was conducted, targeting on improvements of the system construction,internal and external oversight, scientific law enforcement,team building,warning education,comprehensive prevention and other aspects of the Customs against malfeasance crime.This paper summarizes and analyzes criminal malfeasance related literature,as well as theoretical tools used in this paper. Secondly,we analyzed four cases in detail,concluding on China Customs officers’ malfeasance crime situation,and summarize the current Customs officer malfeasance crime problems and preventions,which is the core of this research. The analysis revealed that management is not strict and the system is far from perfect, contributing to Customs officer malfeasance crimes. Legal education is not widely available, the imperfect mechanism of supervision and enforcement of environmental external factors triggered criminal malfeasance, which should not be overlooked.Based on the above analysis;we put forward the suggestion that besides incentive mechanism,the integrated use of administrative;egal,monitoring tools;public supervision are called,so that both the strict management and supervision,education and team building work together to form a systemic risk prevention system;causes for discipline violations and illegal malfeasance,corruption and other violations of law,such as embezzlement,bribery,harboring and involvement in smuggling and other criminal acts,should be “double checked”. The “double check” mechanism will help prevent and control the risk from spreading out the entire field of internal customs inspectors. The education of malfeasance crime is crucial to improve the overall quality and moral sense of customs officers;customs officers and customs officials should set examples for law enforcement and their clean and efficient manners. Ultimately the systematic elimination of the risk of malfeasance is our goal.
