New Energy Subsidies Legal Issues Research In China Under The WTO Framework

Along with global warming, environmental pollution, the emergence of traditional energy sources dried up wait for a phenomenon.at present, the development of new energy has become the consensus of the governments.The development of new energy industry characteristic determines it is difficult to rely on their own strength to grow. In the early stage of development must rely on the government to provide support and help. At the same time, under WTO rules, a part of the new energy subsidies disrupt the interests of other countries, caused a trade dispute. New energy subsidies to relieve the energy crisis and environmental crisis has certain rationality.Excessive subsidies and unreasonable subsidies will also bring a lot of disadvantages and easy to cause other countries anti-subsidy complaints.To reduce the number of other countries to our new energy anti-subsidy complaints, we must be reasonable regulation of subsidies. This article mainly from the following four aspects to discuss China’s new energy subsidies.First of all, it expounds the related concepts of new energy and the necessity of the development of new energy in our country at present. We can know the development of new energy has an important role in alleviating the environmental crisis and ensuring energy security. Through this chapter, the paper introduces the theory system as a new energy subsidies.Secondly, it elaborates the WTO rule under the legal attribute of new energy subsidies. This paper mainly discusses the definition and classification of subsidy in the SCM agreement and for the interpretation of the GATT1994 general exception clause. Finally it elaborates the new energy subsidies and the WTO rules of conflict coordination.The third part mainly describes the present situation of China’s new energy subsidies and the main problems existing in the process of development. This paper introduces the government for new energy legislation situation in our country and the government subsidies on new energy vehicles. At the same time,the paper put forward the lack of new energy subsidies of our country.Finally, in new energy subsidies in China puts forward the countermeasures to solve the problem.
