The Legislation Of China’s Community Correction System

Community Correction System is fully embodies the principle of criminal law to protect human rights. In common law countries, community correction system has a long and has reached the extent of improving. With the deepening of China’s judicial reform, criminal law for the protection of human rights among the content is increasingly valued. Under this situation, our country in more experimental work carried out community correction, and expanded the scope of the pilot in 2005, in a lot of statistical data and practical experience, in 2009 began full implementation, and now entered a phase advance. Changchun summarizing the achievements and problems after previous experimental work, in 2006 to become China’s second batch of pilot community correction, and in 2010 began working in full swing community corrections, since the implementation of community corrections has achieved good results and social repercussions.2011 China’s "Criminal Law Amendment (eight), " and in 2012 the revised "Code of Criminal Procedure," made a provision of community corrections, which also marks the initial establishment of community correction system. Then by the Supreme People’s Procuratorate jointly Ministry of Public Security, the Ministry of Justice issued a "community corrections implementation" of community corrections work practices and guidance.Eighth Plenary Session held four more can be described as a moment of great historical importance of community correction system. Since the Fourth Plenary Session of the eighth to be clear that the introduction of community corrections act, for the draft, "People’s Republic of China community corrections act," the manuscript has been drafted to be considered the relevant members of the group organized by the State Council.But the results and the data are summarized in Changchun since the implementation of community corrections, and a summary of the difficulties and challenges encountered in community corrections of view, still can reflect our community correction is lack of legislation, community correction personnel division is not clear working capital is not in place, the lack of social infrastructure, inadequate implementation of force and other issues. So I used the research methods of positivism, based on the actual results of the work, community correction as a reference in Changchun, the analysis of the existing community correction system deficiencies and problems, and I propose the suggestions will be good for improvement.
