The Research Of The Current Ideological And Political Education On Young Magistrates In China

The fourth plenum of the Eighteenth CPC Central Committee has made that the basic principle of ruling the country by law should be promoted completely, the ideological and political quality, working ability and sales skills as well as professional and ethical standards of personnel ruling the law must be improved, and personnel ruling the socialist law who are loyal to the Party, the country, people and the legislation should be brought up.The specialized personnel ruling the law with good quality need to train and ideological and political work has been given first priority. The people’s court, as the last one of barriers for maintaining fairness and justice has a sense of responsibility towards strengthening the government by law, setting up a socialist harmonious society and realizing China Dream. It plays an extremely important role in resolving social contradictions and disputes. Young magistrates are an important part of the court team,especially for grass-root judges fighting in the first line of trials. Therefore, they are the follow-up force and inexhaustible power for trial in courts, whose growth is to shape the future of courts. Whether in the past or in the future, justice is the soul and life of trials,wherefore young magistrates should be fair and just for the people. In addition to constraints of external mechanisms such as related laws, rules, regulations, the high professional ethics should be required on them. Moreover, ideological and political education has a strong impetus to the training process for young magistrates’ ideals and beliefs, professionalism, and moral quality.In this paper, young magistrate is defined as personnel who are between 23-34 years of age, have qualifications of trial or auxiliary trial, and are engaged in trial or auxiliary trial with high education levels, high qualifications, and good innovation. However, in the current legal environment they have some weak points, such as indecisive to their vocational faith, deficient of controlling trials, incapable of recognizing facts and evidence of the case, and weak of applicable regulatory capacity. The ideological and political education of young magistrates mainly includes educations for world outlook and methodology, the Party’s politics, concept of rule of law, national conditions, policy, and professional ethics, which is characterized by permeability, flexibility, innovation, and exemplarity.Based on the careful analysis of the current status on the ideological and political education of young magistrates, there exist some problems, such as a mere formality,lacking in substance, a single method, and inadequate protection. They are not conduciveto the cultivation of young talent magistrates, the improvement of the quality and efficiency of trials, and the smooth progress to the reform of the entire judicial system. In view of this, it is necessary to adjust, improve and innovate the education system, in order to continuously promote the development of ideological and political education of the court. In particular, their learning should be strengthened, and the importance and urgency of education should be understood profoundly; the content of the education should be improved and enriched, well-directed and scientific education should be enhanced;education methods should be raised; quality of the team and exemplarity and persuasiveness on the education should be made better; and the education management system should be improved and innovated, in order to effectively safeguard the sustainability of educational effect.
