China’s current "Electricity Law" was enacted in 1996 to implement. However, on the other hand, China’s market lags behind the construction of electric power, flawed mechanism of competition, Science price formation system has not been established, power planning and management not in place, It caused a series of deep-seated contradictions and enormous institutional pressure on the environment and other market failures. As an important part of the top-level system design of the power system reform, the current "Electricity Law" have lagged far behind in design orientation legislation, ideas, principles, and on a series of specific legal system, and can not meet the needs of rapid development of China’s power industry.In this paper, the researchers revised as the core of our problem "Electricity Law", analyzed the development of China’s power industry and overall this power system requirements. On this basis, the author analyzes the status and role of the current "Electricity Law" in the whole power of the legal system, as well as the main problems in the legislative and institutional aspects of the concept. At the same time, the authors compared the experience of Britain, America and Japan electricity reform legal construction.
