Discussion On The Couple’s Joint Property Management System

It is very easy to cause the marital property disputes,Therefore, it is need to improve the community property management system in china.By analyzing the deficiency of existing matrimonial property management system in this paper, comparison of foreign, combined with China’s specific national conditions, put forward some suggestions to improve China’s marital property management system.In the first part of this paper introduces the basic theory of matrimonial property management system, the second part analyzes the problems in China’s legislation, The third part introduced the provisions of foreign legislation, summarizes the use for reference to our legislation and legislative experience. The fourth part analysis the necessity to establish China’s matrimonial property management system and theoretical basis.The fifth part is the main content of this paper, according to the third part of the foreign legislation, combined with China’s specific national conditions, put forward some legislative suggestions. First is to set the provisions of matrimonial property management system of principle, followed by the construction of the contents of the couple’s joint property management system, some suggestions on the construction of management system in China from two aspects of the couple’s joint property management rights and obligations of management. Finally, put forward to set very the legal property system and the revocation of qualifications of these two aspects as the couple’s joint property management system of remedies.
