The Research Of Legal Risk Of Intellectual Property Of High-tech Enterprise

With the booming of the knowledge economy, the High-tech enterprises which are based on the Intellectual Property Rights, have risen rapidly and become the core to drive the continuous development of the knowledge economy. However, in the recent years, the High-tech enterprises face more and more legal actions because of the appearance of knowledge economy. It has damaged the operation capacity of intellectual property resources and hindered the enterprises to develop. Therefore, the paper is based on the characteristics of high-tech enterprises in our country, analyzing its problems on the shortages of planning Intellectual Property strategy, mistakes of legal risk, backward in the Legal risk management mechanism and lack of management. It will identify legal risk types which has a great influence on development of high-tech enterprises’intellectual property practice, making the managers have direct understanding of these risks deeply. On the foundation of identifying and analyzing the risks, we can build a system to prevent and control the Intellectual Property legal risks scientifically and efficiently.In order to build good legal and social environment for the High-tech enterprises, not only the enterprises are required to build centralized management system as the core of intellectual property strategy and General counselor for a pilot, but also External legislation and policy support and cooperation are needed. It can avoid the transformation of these risks to crisis maximally from the origin and promote the enterprises to develop rapidly.
