In today’s international community, the international demand for energy is increasingly significant. The energy producer does not match the energy consuming countries, which making the energy of import and export as the national strategy. The difference between China and Kazakhstan’s in energy supply and demand makes the two countries’ energy cooperation growing. However, the geographically gap between China and Kazakhstan makes energy transport become a prominent issue, and the traditional railways, highways, aviation and other modes of transport can not meet or suitable for the transport of energy, while the pipeline transport, with its practical,convenient and efficient advantage, is becoming a widely used mode in energy transportation between China and Kazakhstan. Today, the two countries have the China-Kazakhstan oil pipeline and China-Kazakhstan gas pipelines, that plays an important role in promoting Kazakhstan’s energy exports and guaranteeing the safety of China’s energy strategy. Therefore, the government of China and Kazakhstan put a particular emphasis on energy pipeline’s construction and operation, and regulate the energy pipelines by the way of making laws and signing agreements. However, There are many legal problems in China and Kazakhstan’s energy pipeline transportation, if that could not solved properly, which will hinder the further cooperation between China and Kazakhstan. With the deepening of China-Kazakhstan’s energy cooperation,the energy pipelines also need improved to ensure that China and Kazakhstan can reach win-win cooperation in energy.The article is divided into four parts. In the first part, it elaborates the ChinaKazakhstan’s energy pipeline, and summarize the importance to the two countries.The second part summarizes the general principles from the international legal convention,which the energy pipeline should follow, and describes the energy pipeline law and agreemen about China and Kazakhstan. The third part analyzes the issues which China-Kazakhstan’s energy pipeline exists: namely jurisdiction issues, managementmechanism issues, environmental issues and dispute issues. The fourth part is promoting the proposals of cooperation in legal system to solve the issues in ChinaKazakhstan’s energy pipeline.
