This article is to find out the shortcomings of China's law system of energy efficiency under smart grid by comparative study the different between China's current state of the law system of the energy efficiency under smart grid and European American and Japan's current state of the law system of the energy efficiency under smart grid,then put forward advices on how to perfect China's law system of energy efficiency under smart grid by learning the excellence legislation and outcome,and coordinating with China's reality and legislation trend.This article firstly studies the relationship between the smart grid and energy efficiency,expounding clearly the actively promotion from smart grid to energy efficiency and new energy,and giving advices on how to perfect China's law system of energy efficiency such as by regulating the industry standard of energy efficiency with law.Secondly,this article mainly studies the law system of the important segments such as side demand management,energy management contract,and building energy-saving.As for side demand management,there needs to regulate separately the three main subjects' rights and responsibility;as for energy management contract,there needs to maintain the equality choice rights and equality transaction rights of every subject.Meanwhile,the power plants and energy management enterprise shall public information timely and thoroughly,and insist on orderly competitive.Adhering to technology innovation is another big responsibility for power plants.As for the consumer of energy,they shall full fill the responsibility of coordination or cooperation.The legislation on building energy-saving shall fix the stimulation and incentive system.Besides,by comparing the power price method of China under traditional power grid and smart grid,learning the aboard experience,this article put forwards advices such as bargain rights of consumer and reality time price,and point out clearly that the power price method is one of the measures of energy efficiency promotion.
