Research On Issues Of Security Mechanism Of The Care Service For The Disabled In China

China is a country with the largest population in the world,and the disabled counting up to 8.5 million.In order to facilitate the building of well-off society comprehensively as well as protecting the rights of the disabled to survival and development,our government published “People with disabilities act of the Peoples Republic of China”and established a series of files and policies which centering on the recovery and development of the disabled.But by searching the current laws and policies,it is difficult to find a clear regulation relating to the foster care service of the disabled.Neither the material security mechanism nor the legal security mechanism is sufficient,the deficiencies seriously prevented the development of foster care service.Dealing with the problems in the foster care service mechanism is not only the need of our age,but also the embodiment of human rights protection.This article analyzed the problems of the foster care service mechanism,and offered a thinking on the perspective of law, looking forward to promote the perfection of the foster care service mechanism.In the first part,article reviewed the development process of the related laws and polices about the disabled foster care service,settled the domestic and foreign research present status, introduced the research methods and innovation points of the thesis.In the second part,article discussed the connotation of the disabled foster care service,introduced the three classes disabled and the foster care ways, analyzed the disabled foster care services in the theory of demography,law, management, economics and sociology.In the third part,article discussed the existing problems of the disabled foster care service mechanism in the perspective of the state,society and the individual. At the state level,the problems include lacking law security mechanism, material security mechanism and the foster care policies security mechanism;At the social level,the problems include lacking fund guarantee mechanism,human resource guarantee mechanism and social supervision mechanism;At the individual level,the problems include the shortage of income,the absence of the service personnel ability and the lack of service continuity.In the forth part,thought the peculiarity of law security mechanism compared with others on the basis of the three-level deficiencies,article concluded that many inadequacies can be resolved by the perfection of law security mechanism. Proposed to establish the Foster Care Law,which can fulfill both the disabled and the old,according to the current population-aging trend in our country. Then proposed some thinking for the legislation,enforcement,judicature,publicity and education of the Foster Care Law.In the fifth part,concluded the whole article.
