The Research On The Issues About “Guangzhou Municipal Provisions On Open Government Information”

“Guangzhou Municipal Provisions on Open Government Information”(here after referred to as These Provisions), effective as from January 1st, 2003, is China’s first formal legal document standardizing the disclosure of government information. The implementation of These Provisions initiates transparency of the work of government in China, guarantees citizens’ right to know, prevents the abuse of government power, and provides a reference for the national legislation and local legislation of other regions. However, due to the lack of prior experience, the then experimental enactment of These Provisions, to some degree, are inadequate and imperfect. Besides, with the rapid economic development of Guangzhou in these ten years, it is difficult for These Provisions to meet the requirements of new age. In addition, with the promulgation of “Regulations of the People’s Republic of China on Open Government Information” and other relevant laws, the legality of some articles in These Provisions are challenged. Therefore, it is of great significance to improve These Provisions by confronting problems in the work of open government information, referring to both domestic and foreign government legislation on information disclosure.This thesis starts with the introduction of the origin, the content, and the defects of These Provisions, elaborates the defects in organizational system, the pre-open system, the social appraisal system, the supervise system and social relief system, discusses the indispensability, and inadequacies and their reasons of These Provisions. With consideration of the general context of promoting rule of law since The 18 th National Congress of the Communist Party of China and the present situation of Guangzhou, this thesis puts forward practical policies to improve organizational system, the pre-open system, the social appraisal system, the supervise system and social relief system, to advance the sustainable development of These Provisions and to give impetus to the rule of law of Guangzhou government.
