Legal Analysis Of “Tomb Clearance And Land Rehabilitation” In Zhou Kou

A movement which called “tomb clearance and land rehabilitation” arouses the contradictions existing in the construction of new countryside. Scholars ignore the profound legal problems of this "New Age Movement", while they criticize the expansion of executive power and executive program of the legitimacy.Here are six parts in this paper, respectively as the “Introduction ”, “the conflict between legal and moral ” caused by the “ tomb clearance and land rehabilitation” and “the conflict between public interests and private rights ”, “amendments of these legal questions”, “analysis of this issue from the perspective of environmental law ”and “ conclusion ”in the end.The first part introduces the background of this “tomb clearance and land rehabilitation”,and states the significance of the research,and clarify the logic and view of this paper.The second part and the third part analysis the legal question existing in this events of “tomb clearance and land rehabilitation” which may be easily overlooked,stating the importance of combination of moral and law, from the perspective of the conflict between law and morality, and the view of public interests and private interests. State briefly that the defects of the existing China’s laws,and analysis how to promoting the " development and construction of a country governed by law ".
