With the rapid development of social economy, the social structure has seen drastic changes, the social strata never cease to split and the pattern of interests is kept adjusting. Moreover, the value orientation is increasingly diversified and the social contradiction as well as conflict have gained great momentum. With China’s progress in industrialization, urbanization, marketization and promotion of information technology, a much larger number of migrant workers in urban areas have pushed the capital-labor clash forward to public concern. The bilateral clash has been considered as an inevitable phenomenon in the process of urban-rural integration. As a result of the bilateral clash, labor and social security problem is the most frequent in the cases from both petition and collective petition. This typical type of problems is closely linked with the construction of harmonious society.From the perspective of the social conflict theory, this thesis aims at the factors that lead to collective petition concerning labor and social security by analyzing the current circumstances of labor and social security collective petition in Huangpu District, the data of collective petition from 2008 to 2013 as well as the typical cases in terms of labor and social security collective petition. In recent years, the conflict of labor and social security in this district has got much sharper with much more frequent occurrence of collective petition. In particular, the collective petitioners tend to prefer sensitive period such as major celebrations in order to press the government much harder. The reasons why collective petition of labor and social security occur frequently in this district include its economic transformation and upgrading, industrial restructuring, defective jurisdiction in labor and social security, the innate defects of the petition system, deficiency of the petition and evaluation mechanism, the insufficient performance of labor and social security departments. Aiming at helping improve the functions of the government, the author has made several solutions and suggestions such as preventing the collective petition from happening in the first place, regulating the expression of appeal channel, bettering the petition mechanism, making full use of the positive role of labor union and guiding the labor activists to full maintenance of their legal rights in a rational and effective way. This thesis strives for breakthroughs on the basis of the previous research in the hope that it may provide a certain reference to the subsequent research on collective petition in labor and social security as well as research on how to improve the effectiveness and efficiency of petition mechanism.
