Public Law Service System And Its Construction Research

Since the reform and opening up, along with the growing public awareness of law, Chinese people have become accustomed to submitting the dispute to the court for ruling. However, people’s legal knowledge is still poor. Therefore, the demand for legal services is growing. Our country’s legal service industry, from disorder to gradually standardized, has embarked on a path of rapid development.At present, on the one hand, the demand for legal services is growing; on the other hand, the effective supply of legal services is clearly insufficient and unevenly distributed. Due to China’s large population,, vast territory and regional development imbalance, uneven development between urban and rural areas, and imperfect social regulatory system, legal services varies greatly among different regions. In especial, people at the bottom of society feel more difficult to enjoy fair legal service. To meet basic civil legal needs and build a sound system of public legal service, the concept of public service law came into being.Public legal service is an integral part of public services, which contains both common features of legal services and the characteristics of public services. It can be understood as a public service provided by the government for the purpose of satisfying the demands of citizens’ basic legal service. In a narrow sense, it is a legal seivice organized by the judicial administrative, provided by legal services corporations for free, satisfying the basic demands of citizens’ law services and protecting their legitimate rights and interests so as to realize social equity and justice. Broadly speaking, public legal services include not only activities that the eligibility of subject provides legal services to citizens to satisfy their basic demand for law and guarantee their legitimate rights, but also bear the responsibility of resolving social disputes, carrying out the legal knowledge propaganda, promoting the establishment of the society ruled by law in China.Public legal service system is a sum of organizations and systems established to meet the basic civil legal needs by providing the people’s mediation, legal assistance, legal advice, legal education and other nonprofit legal service under the support of public finances, in which the main body of supplies is the government, social organizations and private institutions. It includes contents of who providing the legal services, what kind of public legal services, how to provide legal services, the process of how to implement safeguards and regulatory services and other basic contents.At present, China’s public legal service system is still in its infancy. There is little study on public law service system. Public law service system building is urgently in need of theoretical guidance. The author as a staff member of the judicial administrative organs of the provincial-level, personally feels that the trend of constructing public legal service system is irreversible, at the same time is troubled with the lack of theoretical guidance. In this background, to solve the difficulties and problems for the public to explore the establishment of legal services throughout the system encountered in the process, I hope to make some personal thoughts of legal services in building the public system, making research has strong modernity and applied.
