Astudy Of The Management Function Of The Judicial Administrative Institution At The Local Level

With the development of economy and society, all kinds of social contradictions more prominent problem, judicial responsibility of public management functions will play a more important role, will have a more important significance to safeguard social harmony and stability. With the vigorous development of justice, more and more problems have been exposed. Continue to appear in the practical work in the new situation and problems, we need to constantly explore, based on lessons of the past experience, continue to explore and promote new ideas and new approaches to the development of justice.Justice is the basic unit China judicial administrative system, is an important part of grassroots judicial organization, responsible for the implementation of the important functions of the administration of justice work. However, enjoy the "social stability of the first line of defense" where the judiciary in reality but because of low status, weak means, less manpower and management functions are not clear, encountered a bottleneck in the development. This paper takes A justice as the research object, showing the actual operation process to develop grassroots judicial survival condition and its management functions, so as to explore the justice should choose the path of how to be able to play out its administrative functions.The article is divided into five chapters. The first chapter introduces the research background, purpose and significance of the article, the article uses the empirical research method to study the article. In the first chapter, the author states the theoretical basis of the article, which is the new public management theory, the new public service theory and governance theory and good governance theory. At the same time, the author of the article related to domestic and foreign articles for the study, the domestic and foreign scholars on the basic level of judicial administrative functions of the research to sort out and make a brief review. The second chapter briefly introduces the basic level of public management functions of the property and value, summarized the three main values are: to strengthen the legitimacy of the government and the party’s ruling position, is conducive to the construction of democracy and the rule of law, fairness and justice, harmonious and stable society, is conducive to safeguarding the interests of the people. The focus of the article is in the third and fourth chapters. In the third chapter, the author makes an example of the management function of the basic level administrative organs, and the author makes a statement on the status quo of the public management function of the judicial system, and concludes the four problems: Constitution deficiency, the conflicts between the government power and the residents’ autonomy power, the importance of the judicial system is not suitable for the social status’ embarrassment, and the construction of the grass-roots judicial administrative cadres is not suitable for the development of the new period. The fourth chapter analyzes the problems existing in the management functions of the basic level judicial administrative organs which are the conclusion of the third chapter. The problems is mainly presented in four aspects, the judicial system is missing, the judicial management level lags behind, the judicial system is not scientific, and the judicial administrative departments are famous but no real. The author puts forward some suggestions on improving the management function of the basic level judicial administrative organs: increasing propaganda, expanding social awareness, strengthening the construction of the team, adapting to the needs of development, matching the basic financial allocation, and finally put forwards the relevant departments of the grass-roots judicial administrative organs. This paper expects to carry out the implementation of the relevant departments of the judicial functions of the judicial department which could make a certain contribution to the judicial department.
