Study On The System Of Duty Crime Investigation Bargaining

In job-related crime investigations, evidence can be quickly obtained by investigation bargaining, thus the investigation process will be greatly shortened. Weighing the advantages and disadvantages, criminal suspects will truthfully confess for a mitigated punishment. This is the result of a game and compromise between public power and private rights. Certain immature attempts in bargaining have been made in current job-related crime investigation practices, which saved judicial costs. However, without unified application range, application program, and necessary supervision mechanism, job-related crime investigation bargaining hasn’t been clearly defined. So, it is questioned by some scholars. This paper tries to analyze the difference between Judicial Bargaining, Plea Bargaining, and Investigation Bargaining, then comb through the practical approaches of job-related crime Investigation Bargaining in judicial practices. On this basis, the paper concentrate on investigates the legitimacy of the system regarding the procedural justice and proposes the feasibility of system establishment and specific details.
