Research On The Reform Of Household Registration System In China

The system of census registration law lies in the foundational position in the system of state administration, and it affects the development of economy and society of a country in a big way.This system occurred from the entering of the enlightenment era of our human beings.The census registration system is closely interrelated to everyone’s daily live, especially for the inhabitants of our country. With the development of the social reform and the awareness of the right, we find that China’s current household registration legal system has more and more disadvantages.Although after 30 years of reform, it has not been fundamentally improved.This paper starts with the formation of Chinese contemporary household registration system, analyzes the establishment of the contemporary reform of household registration system and the evolution of social and historical background, analyzes the irrationality of the problem from the legal level; based on the current special background of China’s economic development, combined with the foreign advanced experience of the household registration system,puts forward concrete suggestions to the solving of China’s household registration system reform which should start with an essential function.The article introduction part briefly introduces the current China’s household registration system between urban and rural duality. With the gradual development of economy and valuing the household registration system, the basic rights of citizens are strictly limited in census register seat,greatly weakened the function of the rights of citizens should be,indirectly led to the "census register isolation", have gradually become an important obstacle restricting the development of the national economy.The first part, introduces the general theory of China’s household registration system.Through the meaning of China’s household registration system and the basic function of the household registration system, points out that the household registration system as a means of countries to supervise and control the population, closely related to citizens’ equal rights to freedom of movement to achieve.The second part, firstly introduces the establishment of the contemporary household register system and the reform process.The first stage from 1949 to 1957, is a process of preliminary set up and improve the household registration system.At this stage in the early citizens have freedom of movement and enjoy more rights, this stage later along with the establishment of the system of planned economy and improvement of urban registered permanent residence migration is strictly controlled.The second stage from 1958 to 1978 is divided into the establishment of binary for the household registration system in urban and rural process, the city and countryside account migration strong defense preparations, closely combined with the vital interests protection accounts and citizen, citizen if no account will be difficult to survive.The third stage is the process of the household registration system reform step by step since 1979, it is because of the establishment of market economic system requires the household migration freedom and mobility.Secondly weakening rights which exist in view of the current household registration system function, the edge of urban floating population problems, points out the necessity of the current household registration system reform.The third part, introduced the household registration system which is similar to the United States and Japan, Canada on the premise of combined with national conditions and current situation,points out the direction of the household registration system in contemporary China to deepen reform. In order to realize citizen’s freedom as the goal, change the household registration management,restoration of the household registration system was statistical population numbers and provide proof of citizenship function unification of urban and rural residents, and at last the household registration management would be unified.The fourth part, the paper puts forward specific measures to the household registration system in China. At the legislative level, through formulating unified household registration law, building perfect legal system of the household registration; at the management level, establishing a new type of household registration management system. Coordinating all kinds of household registration affairs, to ensure that the household registration law enforced.At the same time establishing and improving rural land disposal mechanism of housing security mechanism,matching the new household registration system of family planning system by supporting the related policy and social security of deepening reform.Establish a unified, standardized labor market and promote rural surplus labor reasonable and orderly transfer to city, to reduce the instability of the floating population residential and facilitate the management of the floating population.Finally, constructing the new system of citizens, incorporating all farmers into the city into the new citizens, giving them and all citizens the right to equal employment non-discrimination competition and other new citizens rights, equal pay for equal work to achieve unified urban and rural household registration management.
