A Study On Land Enforcement And Supervision From The Holistic Management View

The using of the land has a huge externality. Especial in the situation that the land right is public ownership, the land is a special public resource. The over-entry and overuse happens every, for example, the tragedy of the commons. Such external diseconomies should be decreased by government. Today, the number of the land offenses is still very large, and the scale of the land also big, the kinds of land offenses also increasing. The land enforcement and supervision is obstacle in many fields. If we conclude the reason of the land offenses, we can find that the reason is the land management institution has some defects. It is the institutional defect leads to the land offenses cannot be stopped. The executor of the land enforcement and supervision should not be flogged. The institutional defect can be concluded as "Everyone use, one manage". So the reform of the land enforcement and supervision from the public management view is necessary. In this study, chose the holistic governance as foundation, chose Nanjing as study area and use case study as research methodology. After analyze the difficult of the land enforcement and supervision. At last, the article gives the policy suggestion.After the study we can find in common that many seriously defects of the holistic governance exist the land enforcement and supervision institution. The governance structure of the Land enforcement and supervision is de fragmentizing. The departments about the land use lack of the cooperation. Sometimes even have conflictions. So the land department always in the dilemma, the land department cannot handle the land question by themselves. So the question of the land enforcement and supervision need the institutional reform. Build the common responsibility is the most import reform. Use the gridding enforcement mode as the vector to accomplish the common responsibility working mode. Push the holistic governance improvement in the macroscopic and collaborative governance improvement in the microscopic. Then we can build a new mode which can be called as "Everyone use and everyone supervise".The policy suggestions are four points. Firstly, change the goal of the land use, the key point is local government. The government’s land use should not only take care of the GDP, the order of the land use should take into count of the local government’s check. Secondly, the reform of the holistic governance is necessary; the land administration department should be more independent. Thirdly, from the collaborative governance, the cooperation in department should be forced by law. The institution of information disclosure and information circular should be more complete. And take the building of the gridding enforcement as the keypoint.At last, the institution should be dynamic. As the economy and society is developing every day, so the institution of land enforcement and supervision should develop as follow.
