Research On The City And Township Mediation Issues Of Rural Area In Taiwan

The public has much improvement in the awareness of law while in the process of the development of economy and society. More and more people prefer to choose legal ways to solve the problems happened in their lives. But this situation brings lots of pressure to our judicial system because they take trifles to court without considering the importance of their problem. Under this circumstance, the method of mediation naturally attracts lots of attention. The differences which exist in social system and development between Taiwan and mainland determine that the way how mediation measures act are different. This thesis mainly discusses Taiwan mediation system in four parts, thus propose some suggestions to perfect our country’s people’s mediation system.The first part is an overview of mediation system in Taiwan village. From the conception of mediation in Taiwan, the characteristics of substantive, the economy and voluntary and unpaid. It also introduces the shortages of convenience in mediation, build a preliminary understanding about their mediation system by illustrating the origin of village mediation, their characteristic, function and legislative activities.The second part elaborates the basic conception of mediation in Taiwan village from three aspects. It introduces the formation and structure of the mediation committee, and how they acting and the legal effect.The third part compares the differences of mediation measure between Taiwan village and mainland. By this way, this article aimed to make a better understanding of the commons of the propose of legislation, the public welfare and the supervise of government. The difference are the scope of cases, the confidentiality, the mediation committee, the mediation effectiveness and relief channels.Based on the analyze before, the fourth part of this article brings out some applicable suggestions to perfect our country’s mediation system by using what we have studied from Taiwan.Among those advises contain proposals to adjust the types of cases, the conciliation committee to improve the structure and the enhance of quality of justice confirmed unilateral application system, and the improvement of the judicial confirmation while emergency and so on.
