Study On The Government Responsibility Of Environment Pollution Prevention And Control

On Nov.8,2012, the 18th National Congress of the Communist Party of China (CPC) made a strategic decision on promoting the construction of ecological civilization. On May 5,2015, The CPC Central Committee and the State Council on Accelerating the Construction of Ecological Civilization was published. On October, the Third Plenary Session of the 18th Central Committee of the Communist Party of China made a decision to enhance the construction of ecological civilization was included into the national five-year plan for the first time. The reason why the construction of ecological civilization attracted attention is that the pollution of the environment problem became an increasingly serious problem. We have reached a very critical stage. Economic development cannot be at the expense of destroying the environment, and sustainable development should be based on the basis of harmony between man and nature.In the foreseeable future, environmental pollution and economic development will be a hot topic. And taking on responsibility of pollution control of the government has a long way to go.From the perspective of environmental pollution control and government legal responsibility, this paper attempts to study the issue of environmental pollution and attempts to sort out a set of effective methods to help the government to control the pollution of the environment. This paper studies the government’s responsibility in the environmental pollution control by the methods of literature analysis, comparative research and system analysis. The study found that government legal duty is a vague concept; responsibility is not clear; the provisions of the system is imperfect,; an effective enforcement mechanism is incomplete and supervision system set unreasonable and so on. Therefore, from the field of administrative law on the environmental pollution and government legal duty, this article attempts to analyze the meaning of pollution control and the meaning of the government legal duty. Through the improvement of legislation, this paper puts forward some rational suggestions on the clear government roles in environmental pollution control, complete enforcement procedures, clear responsibilities and the clear supervision system etc.The State Council is the highest leading organization in the pollution control work that the provinces, autonomous regions and municipalities are directly under its supervision, and the city government and the county government are directly responsible for the specific implementation. It is important to clarify the various levels of government responsibility in the process of pollution control, and establish a scientific and reasonable evaluation mechanism of environmental pollution control. Learning from the experience of western government governance pollution, and combing with China’s national conditions, we should build the responsibility system which is in line with China’s national conditions and the reality of environmental pollution control. The construction of responsibility system is beneficial to improve the government ability of pollution control, to speed up the construction of ecological civilization, ultimately achieve sustainable development.
