| In the last few years, the development of the national economy has lead to the oil security of our country being not optimistic. As a result, since oil is a non-renewable resource that is important for the stability of social, economic of national and national security, so it is the top priority to perfect the legal systems for oil use.The research has been conducted using a few methods such as induction and comparisons and has made every effort to fill the lack of legal science research on petroleum reserve legal security and discussed through legal means to build, standardize and improve the system of our country’s oil reserves. This thesis is divided into four parts. In the first part of this thesis, the national oil reserve has been defined as the important element for maintaining resource, economy growth and national military security. National Petroleum Reserve can help prevent from crises of short supply and large price change according to supply and demand on the market. From the perspective of politics, economic security and law, further research of the national petroleum reserve legislation is carried out. The second part, through the narrative of the United States, Japan, Germany, three national oil reserve legislative cases, in-depth analysis of the reserve scale, the source of funds, and the important issues of legal, and the comparison of characteristics of national legislation and practical experience, the enlightenment to China’s national petroleum reserve legislation is acquired. National petroleum reserve will improve resource management legislation, helping strengthen the economy as well as improving supply for petroleum and petrol products. Policy and legislation work together to support the petroleum reserve system and through growing experience has been developing for many years now. The third part of this thesis, explains the necessity and feasibility for petrol reservation. The forth part is a proposal for the legislative structure required for petroleum reservation. This includes a draft for the Natural Gas legislation as well as the National Petroleum Reserve legislation, giving a detailed structure of the legislation divided into three main categories of managing the petroleum reserve system. This will be lead by Government funding followed up by additional funding from various sources. Further to this it will explain the limitations and distribution of the reserve.This thesis has concluded that the establishment of the legal system of China’s National Petroleum reserve is urgently needed. We should accelerate the construction of the legal system of national oil reserves and make the whole process of the construction of our country’s oil reserves into laws and legislation as soon as possible, mechanically feasible and with legal protection. Using experience from other developed countries whilst also considering China’s economic and political situation we should look to further develop our legislation for our National Petrol Reserve. |
