Research On The Legal Issues Of Oil Reserves In China's Oil Companies

With the development of economy,the demand for oil is increasing.However,due to the constraints of exploration technology,mining difficulty,mining technology and equipment,domestic oil production is far from enough to support China's huge oil consumption.As a result,China's dependence on foreign oil has been rising,has surpassed the United States as the world's largest oil importing country.Such a high degree of dependence on foreign oil so that China's oil supply security is easy to be controlled by others.Adequate national strategic petroleum reserve is an important guarantee for the safety of oil supply in China.However,due to the late start of China's petroleum reserve,and the lack of corresponding legal system to the planning,construction,operation,management and supervision of all aspects of the specification,resulting in petroleum reserve in our country is far lower than the international safety standard line 90 day standard.Therefore,it is urgent to promote the construction of China's strategic oil reserve by perfecting the domestic oil reserve legal system.The petroleum reserve of petroleum enterprises as an important part of China's strategic oil reserve,to study its relevant legal system,it is of great significance to improve the legal system of China's petroleum reserve to find out the problems and put forward countermeasures.Based on the above considerations,this paper will study the legal problems of China's oil company's obligation to reserve oil,and put forward countermeasures.This paper is divided into two parts:introduction and text.The introduction mainly introduces the research background,purpose and significance of the research,the research status at home and abroad,the research content and research methods.The text is divided into four chapters.The first chapter is the overview of petroleum reserve of petroleum enterprises,analyze the reasons through the importance of enterprises,petroleum reserve of our country at present,the status quo,and the "national oil reserve Ordinance(Draft)"(hereinafter referred to as "the draft")regulations of petroleum reserve of petroleum enterprises explained the significance,basic theoretical knowledge related to contribute to a better understanding of China's oil enterprises of petroleum reserve.The second chapter is the "draft" on China's petroleum reserve of petroleum enterprise regulations and the insufficiency,the first of the "draft" on China's petroleum reserve of petroleum enterprise regulations were introduced,and then analyze the specific problems,and discusses the reasons for the existence of these legal issues.The third chapter is the legal system of foreign related and reference,this chapter introduces the German and Japanese Regulations on corporate legal system of petroleum reserve,has carried on the refinng and summed up how to improve the enterprise of petroleum reserve in China with reference place.The fourth chapter is to solve the "draft" on the existing problems of oil reserves of petroleum enterprises,this chapter on the basis of the experience of Germany and Japan on the enterprise legal system of petroleum reserve,combined with national conditions,puts forward some concrete suggestions to deal with the problems of "draft" that about the oil reserves of petroleum enterprises.
