Research On Countermeasures Of Duty Criminals’ Supervision And Reformation

Since the holding of the 18 th Cpc National Congress, our party has been holding a very tough and decisive attitude toward the current anti-corruption work. There is no exception when it comes to the people who violate party discipline and the laws of the state. All of them will be punished seriously no matter who they are. Recently, the rate of duty criminals that are sentenced to be in prison is rising year by year under the growing strength of punishment of duty crime in our country. Without doubt, they are objective group, which become a great challenge of reformation to penalty execution in prison. However, it should not be ignored that how to perfect the prison remoulding of group commit crime more scientifically to improve the criminal rehabilitation since our China has been in the period of transformation of social reform and development. If China is not powerful itself, the reform will be in danger of failure when faced the complicated and changeable international environment. At present, the theoretical researches of supervision and education of duty criminals are growing in our country. However, it is still felling its way as a whole. Moreover, comparing to the prevention and punishment of duty criminals which is popular in China, the research of its reformation is relatively less in academia. However, Duty crime is not only provided with the nature of itself but also with special subjective characteristics. And the basic rules and experience of duty criminals reformation can be concluded through connecting practical demand of duty criminals’ remedial treatment and analyzing all kinds of characteristics in duty criminals expressed in the period of prison remoulding. Also, it puts forward the countermeasure research of duty criminals’ penalty execution in order to educate and reform the duty criminals. The function of this work is to summarize and study the experience of how to prevent duty crime. Because it is an important mission of the current penalty execution that how to prevent duty crime from the source by taking advantage of correcting duty criminals effectively to build a just, clean and effective Chinese government. Furthermore, it is a significant guarantee to build a socialist harmonious society.According to the practice experience of oneself and working experience, the author combines the academic achievements of the related experts and scholars, elaborated the study from the following three chapters; Firstly; posing a problem; based on a prison in Hu Nan province, the study makes a investigation of duty criminals in prison and then discusses the causes of crimes and the features of reformation; Secondly, analyzing the problem; it analyzes the gains and loses of prison reformation of the present duty criminals from policies and laws, supervision models, contents of building, strict enforcement, self-knowledge, and policemen’s talents. Thirdly, solving the problem; in this chapter, the study explores how to improve the management pattern for the present duty criminals further by using the educational reformation ideas scientifically and then puts forward the advice of countermeasure.
