They should examine or audit the law enforcement from legality, rationality and justice in order to protect the legal right for both the patrol police and the citizen effectively.By the combination of theoretical investigation and typical case analysis, this thesis tries to clarify the current development trend in the patrol police law enforcement work, and figure out the dilemma between strictly follow the enforcement regulation and the practicing the law efficiently,,and the problems in lack of professional training, failure of the effect of law enforcement, tending to infringe the rights of citiazen, also the verbose and slow schedule for patrol polices to ask for their own legal right, and the difficulty in protection of the right of patrol officer. Utilizing comparative method in law researching, this thesis chooses three nations to compare with the law enforcement of the Chinese patrol police, which are:USA who has the most detailed and advanced specification and regulation in law enforcement of patrol office; Japan and HongKong which are also in Asia and share the similar tradition. By induction, deduction, comprehensive analysis, and absorbing the essence of advanced patrolling system from foreign countries, this thesis proposes following advices:respect the procedure, formality of amending and practicing law, avoiding temporary change by special case; further detailing the regulation and enhancing the cooperation among all the other polices, improving the operability of legal base for law enforcement;, enhancing the training for the patrol police, eliminating the nonstandard practice in everyday work, and improving the regularity in the procedure of law enforcement and the effect; making the audit of law enforcement for patrol police normalizing and standards, both in the department of police supervising and legality monitoring, perfecting the safeguard and guarantee mechanism, and insisting on advertisement on the information and knowledge of law.
