On The Cancel Of Checking Chinese Citizen’s Visa Of Destination Country

Through the study on legislation of "Exit and Entry Administration Law " and research on demand of exit and entry passengers, combining with the development situation of entry and exit ports in China, development process of current entry and exit system and difficulties when examining visas to the destination country of Chinese citizens, this paper analyzes the advantages and disadvantages of examining visas to destination country of Chinese citizens. In terms of revising laws, maintaining security and stability of ports as well as complying with the further demand of service objects of frontier inspection, it studies the feasibility of canceling the examination of Chinese citizens visas to destination country and proposes the suggestion that Article IX of "Exit and Entry Administration Law" should be modified: cancel the examination of visas of Chinese citizens to destination country.At present, there is a severe shortage of legal basis of the examination of visas to destination country of Chinese citizens and basis for judging the administrative decision in accordance to it. The paper discusses issues on how frontier inspection departments can work effectively and facilitate the exit of citizens and thus provide powerful legal protection, as well as on solving the problems of ambiguity of rights and responsibilities in judicial practice and legislation lag.The contents of this paper are mainly composed of four parts. Chapter One, as the beginning of the whole paper, mainly introduces the concept of visa to destination country and the current practices and relevant legal norms of the examination of Chinese citizens visas to destination country. Chapter Two analyzes the problems existing in examination system of examining Chinese citizens visas to the destination country, including the deficiency of specific procedural provisions, inability of effectively identifying the visas and incompatibility with the current entry and exit situation. Chapter Three analyzes the feasibility of canceling the examination of visas to destination country of Chinese citizens. Chapter Four presents that in order to ensure the management order of ports after canceling the examination of visas of Chinese citizens to destination country, in what ways our country can strengthen the border inspection, further standardize the border institutions and their works, as well as refines the improvement of the credit evaluation system, in order to build a unified and coordinated entry and exit system in line with international norms and make full use of it.The ultimate purpose of this paper is to provide reference and suggestion for the improvement of reform on entry and exit system.
