Research On The Realization Path Of The Government Power List System In China

In recent years, the local governments launched a pilot project aims to explore the government’s power list system, and summed up a lot of useful experience, which provide a good practical foundation to establish and improve the government’s power list system. Adopted by the Eighth session of the Third Plenary, "CPC Central Committee on Some Major Issues Concerning Comprehensively Deepening the Reform" firstly decided to establish and implement government power list system from the central level in China. Local governments and their departments should work to implement the system of government power list at all levels, emphasized that keep the list of the authority of government open while running the process of administrative power to open. The Eighth session of the Third Plenary emphasized furtherly the system of government power list, require to "implementation of government power list system, and resolutely eliminate rent-seeking space rent-power". Since then, the government power list system started coming into view, become the focus of attention and research community. At present, China has already begun in some places to explore and establish and improve the practice of government power list system. They have achieved some initial results, but there are many other problems and challenges varying from force of law, legal, to responsibility for monitoring mechanisms. We must carefully studied the issue that how to further improve China’s list of government power system to ensure achieving its value.Through the integrated use of semantic analysis, comparative analysis, empirical analysis and other research methods, this paper, firstly, clearly define the government’s power list system connotation and denotation. Based on the theory of administrative legal principle, the principle of public administration, administrative services and the concept of limited government theory, Government power list system is the center of administrative power, the power of government inventory preparation, operation and supervision of the content of a legal system. Implementation of government power list system is very significative to the theoretical study of administrative power and administrative power of norms and constraints. Secondly, through presenting the establishment and development process of government power list system, this paper affirms the achievement as well as analyses the existing problem of government power list system at current stage. On the one hand, our country government power list system has already made some achievement within combing and standardize administrative power and ensure the operation of public power; on the another hand, China’s government power list system is not perfect, there are many problems, such as the legal position of the system, the lack of unified standards and norms, the development and implementation of the program is not reasonable, the lack of responsibility for the supervision mechanism and other relevant supporting mechanisms. At the background of reform of the administrative system and the continuous development of the Internet, this paper combined the practical experience of the government power list system in our country and the background of our country and the background of the rule of law, and put forward the realization of the system of government power list with the perspective of the rule of law, based on the theory of the system of government power list. By improving the laws and regulations related to the list of powers of the government, the legal effect of the list of powers to the government is given. Besides, this paper optimizes the contents of the list of government power, and standardizes the legal procedure of the system of government power list. Furthermore, this paper introduce that improving the relevant responsibility supervision mechanism and supporting mechanism, to realize the value of the system of government power list system.
