| The government as a public authority agent, is both the arrangement of institutional system and the actor of government reform. Currently, government reform has entered a crucial stage. The focus problem of the reform is to curb the power of bureaucrats, rein in government spending, and deal with the relationship of government, market and society. The third Plenary Session of the 18th CPC Central Committee pointed out for the first time that all levels of government must implement mechanism of power lists. The implementation of power list, not only to provide institutional support for the current decentralization, but also provide the normative security for the reasonable and effective decentralization. From the practical reform, the central government has put decentralization and mechanism of power list combined together. The two complement each other and work together to promote.This paper based on the theoretical summary of mechanism of power lists, and combination background of decentralization and authority control, points out the aim of the implementation of mechanism of power lists. The aim is to out of the historical cycle of decentralization and retake the power, and get rid of the long-term difficulties of swelling and abuse of power. Mechanism of power lists is a new institutional exploration in the field of power allocation and power control, which helps to build a simple and efficient government system, and regulate the daily operation of government power. In this context, this paper defines the concept of the mechanism of power lists. This article argues that the mechanism of power lists is the entire process, which based on carding and cleaning existing powers. The mechanism put power name, category of power and exercise subject as course, define the scope and boundaries of power, and open to the society. The mechanism of power lists has three characteristics, which are universality, legitimacy and reform. At the same time, it includes two functions, which are clarifying the boundary and compressing the space of rent seeking.The basic process of China’s power list system is implemented by two stages:the budding exploring and unity promotion. It should be discussed through in particular from the central and local governments. Through the comparative analysis of published local authority list, the author found that the implementation of local government power list-making processes are basically the same. The processes is generally established on carding existing authority legally, according to the administrative authority to retain, decentralization, adjustments itemized way to clean up. And finally public the basic information about implementation of the main government authority, basis, class series to the society. Meanwhile, the paper also selected the list of power in Jiangsu Province to carry out the situation as a case study, focusing on making a relatively detailed description of its list of specific powers and content structure. Through the study, the list of powers of Jiangsu Province completely covers the province, city and county, using the same standards in a province-wide inventory levels, which are strong scientific and representative. Through access to relevant news and academic literature, this paper summarized the exploration process of mechanism of power lists which from local to center. The basic process of mechanism of power lists.Construction of the current government power list system has achieved good results, at the same time we must admit that as a start-up system, there are still some problems to be solved. From normative and effectiveness two angles, this paper views the existing problems of the power list system. Mechanism of power lists is insufficient in system design, which reflected in the lack of legal effect and supporting system is not yet in place. The lack of efficiency in implementing power list system, reflected in the effect of decentralization and authority control is not obvious, and the ability of market and society to undertake the transfer of government functions also need to upgrade. In view of the above problems, this article from three aspects of the legal system, responsibility and government functions, put forward the power lists’ adjustment strategy and the direction of optimization. The first is to promote the legalization of the power list system, which means to strengthen restriction effect of the power list system in the premise that put the power list system on the legislative agenda. The second is to realize the unity of government power and responsibility. The specific needs to improve internal assessment and external oversight mechanisms of the power list system, while establish the system of responsibility which match power lists system. Finally, the power list system and government function reform should be combined to further rationalize the internal relations and external relations of government functions, to build a new pattern of government, market and social cooperation.Of course, China’s power list system is still in the exploratory stage of implementation, the carrying of the reform of the target cannot be achieved overnight. We have a lot of problems in the studying and practice of the power list system, but also need us to improve the list system on the rational basis. In short, only when the government changes the traditional management thinking, establish government, market and social cooperation governance system, it can better play value of power list system, in order to achieve a good wish for no authority outside the power list. |
