Research On The Problems And Countermeasures Of Law Enforcement Of Urban Administration From The Perspective Of The Law-ruled Government

In recent years, reports on illegal and even violent law enforcement of urban management were frequently broadcast, which exposed varieties of serious problems which extremely depart from the connotations and requirements of the law-ruled government. Aiming at promoting the construction of a law-ruled government, regulating the subject, means and methods of law enforcement of urban management and guaranteeing the legitimate and justified rights and interests of law-enforcement counterparts, this thesis is intended to probe into the problems exposed in the process of law enforcement of urban management and put forward their corresponding countermeasures from the perspective of the Law-ruled Government Theory. For the overall structure, this thesis is mainly composed of three parts except the Introduction Part.The Introduction Part is the literature review, which generally summarizes the relevant documents. Part One presents the definition of law-ruled government, the essence of law enforcement of urban management and the requirements for urban management. Part Two categories the existing cases and analyzes the form and content of legislation in the aspects of laws and regulations. Part Three puts forward some reliable measures for promoting the legalization of law enforcement of urban management through interpreting the reform idea of law-ruled government.Urban management needs to be conducted in a well-organized environment. Considering The idea of the law enforcement of urban management under the rules by law can not only change the original urban management systems in order to improve it to a more scientific level,but also conform to the core value advocated by the harmonious society. Based on the Law-ruled Government Theory, this thesis mainly adopts Case Analysis Method and Mathematical Statistic Method to classify the problems existing in the law enforcement of urban management in China.The Case Analysis Method focuses on the analysis of the legitimacy of the subject, practice andmeans in the law enforcement cases, while the Mathematical Statistic Method concentrates on the categories and brief analysis of the collected data. What’s more, based on the state and local legislation, this thesis analyzes the legislative reasons for the problems existing in the law enforcement of urban management in both the practical situation and the legal theoretical level and puts forward some corresponding countermeasures to improve the construction of the rule of law system in the pattern of law-ruled government.
