Study On In-event And After-event Supervision Of Items Of Administrative Examination And Approval Under The Perspective Of Governance Theory

Our government has long been used to approve the administrative affairs instead of supervising them. The government always intervenes too much in the micro economy, and attaches more importance to "approval", not "regulation". As a result, not only the vitality of economic development is inhabited, but also lead to high cost and administrative corruption. In order to comprehensively deepen reform, we must accelerate the transformation of government function, while comprehensively and correctly perform the functions of the government, which was cleared in the decision of the third plenary session of the eighteenth, in November 2013. The key point of reform is to balance the relationship between the government and the market, and give better play to the role of the government. On one hand, it should streamline administration and delegate power to the lower levels, so that it can avoid too much direct intervention on the market or resource allocation, and the market can fully release the vitality. On the other hand, it should strengthen market supervision and maintain market order, in order to create a fair competitive environment for development. Therefore, an innovative regulatory approach should be proposed. Let us change the traditional regulatory thinking, to implement the in-event and after-event supervision of items of administrative examination and approval.In this thesis, governance theory is chosen as the theoretical basis of the study. The applicability of governance theory is reflected in the consistency of the concept of in-event and after-event supervision and the ideas of governance theory. The problems of in-event and after-event supervision can be solved by governance ways. So. the main points of governance theory, such as multiple subjects, mutual coordination, and continuous interaction, are incorporated into the analysis of the current situation, problems, causes and countermeasures in the in-event and after-event supervision of items of administrative examination and approval. In China at present, the State Council set up four free trade zone (FTZ) in Shanghai, Fujian. Guangdong, Tianjin and Fujian. They are the pioneers of reform. This thesis summarizes the major initiatives of the in-event and after-event supervision in Shanghai FTZ, Guangdong FTZ, Tianjin FTZ, and Fujian FTA, and also, analyses how to use their experience for reference in supervision of items of administrative examination and approval. At the end of the thesis, it gives some suggestions to improve in-event and after-event supervision of items of administrative examination and approval, which based on the governance theory and the current existing problems and the reasons, as well as refer to the practice and experience of the free trade zone. First, the government should develop and improve regulatory documents of in-event and after-event supervision of items of administrative examination and approval. Second, it should be built a diversified regulatory system. Third, it should be formed participants coordinated mechanism in in-event and after-event supervision. Fourth, it should be implemented a whole process of supervision of items of administrative examination and approval. So we can have a dynamic, continuous, all-round and whole-process in-event and after-event supervision of items of administrative examination and approval. It will therefore realize the transformation of government functions, safeguard the public interests and create a fair and orderly market environment, then promote the economic development of our country.
